The Lawsuits

Virginia is "....home to more Confederate statues than any other state (110 in 2019, according to the Southern Poverty Law Center). [1]

The Commonwealth of Virginia, under the direction of Chief Counsel to the Governor Attorney Rita Davis, has been laying the legal foundation for removal of the Lee statue for years.

Five Monument Avenue residents, represented by Patrick McSweeney, have an active lawsuit to bar the removal of the statue. These residents most likely have the backing and financial support of Klan-adjacent, white nationalist, white supremacists groups. Helen Marie Taylor, the most prominent of these residents, is a long-time, vocal defender of "Lost Cause" propaganda in the form of statues.   [2]

Approximately 50 families in the vicinity of the statue have filed an "amicus" brief requesting the removal of the statue. [3]

There have been several appeals. withdrawals, and refilings of the various suits.

As of January 2021, the lawsuit has lost its current appeal and is waiting for one last effort to reinstate the suit.

It is our belief that the people who should decide the final disposition of this statue are the Black, Brown, and Indigenous people of color who are subjected to the daily psychological torture of being forced to see this Jim Crow-era relic looming over Richmond's landscape.
